[ EXECUTIVE ORDER NO. 72, October 28, 2024 ]
ADOPTING AN INTEGRATED AND HARMONIZED PROCESS FOR FORMULATION, APPROVAL, BUDGETING, IMPLEMENTATION, AND MONITORING OF MASTER PLANS FOR THE INFRASTRUCTURE SECTOR
WHEREAS, Executive Order (EO) No. 230 (s. 1987), as amended, constituted the Committee on Infrastructure (INFRACOM) under the National Economic and Development Authority (NEDA) Board, to study and recommend policies, programs, and projects concerning infrastructure development consistent with national development objectives and priorities;
WHEREAS, the State recognizes the crucial role of public investments in infrastructure and human capital geared towards creating employment opportunities and promoting economic growth;
WHEREAS, one (1) of the key strategies identified under the Philippine Development Plan (PDP) 2023-2028 is the implementation of integrated master-planning development and convergence programs towards sustainable, resilient and modernized infrastructure facilities and services;
WHEREAS, it is imperative to harmonize and strategically integrate the process for the formulation of master plans for the infrastructure sector to guide the planning, programming, budgeting, and implementation of infrastructure projects, and ensure a holistic approach to socioeconomic development; and
WHEREAS, Section 17, Article VII of the Constitution vests in the President the power of control over all Executive departments, bureaus and offices, and the mandate to ensure the faithful execution of laws;
NOW, THEREFORE, I, FERDINAND R. MARCOS, JR., President of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, do hereby order:
Section 1. Policy. All departments, agencies and instrumentalities of the National Government, including government-owned or -controlled corporations, involved in the planning, development and management of infrastructure projects, shall adopt an integrated and harmonized process in the formulation, budgeting, approval, implementation and monitoring of the implementation of master plans for the infrastructure sector.ℒαwρhi৷
Section 2. Formulation and/or Updating of Master Plans for the Infrastructure Sector. In the formulation, updating, development and management of master plans for the infrastructure sector, all concerned govenrment agencies shall:
a. Incorporate applicable physical, spatial, and other cross-cutting elements and principles, such as convergence, interconnectivity, digital technologies and solutions, environmental quality and ecological integrity, sustainability, climate change resiliency, disaster risk reduction and management, and gender equality, disability and social inclusion. Due consideration should be given to aesthetics in identified tourist destinations covered by infrastructure master plans;
b. Ensure complementary of proposed master plans with land use and urban planning initiatives, especially master plans with inter-sectoral coverage and concerned, as well as alignment with other plans, programs, and projects at the national and regional levels;
c. Consult relevant stakeholders, including academe, civil society organizations, and business sector, in the formulation of master plans relevant to their respective sectors;
d. Ensure that the key infrastructure projects identified in the master plans are consistent with the Public Investment Program and Three-year Rolling Infrastructure Program of the government;
e. Review and update the infrastructure sector master plans as may be necessary, to ensure that it is synchronized with the PDP. The review and updating of infrastructure sector master plans shall be subject to Section 4 hereof; and
f. Submit an annual report to the INFRACOM on the status of implementation of master plans, including the progress on the achievement of its targets.
Section 3. Submission to INFRACOM. All master plans of national scope for the infrastructure sector and its sub-sectors, including transportation, water resources, energy/power, information and communications technology, and social infrastructure, among others, must be submitted and approved by the INFRACOM prior to its adoption and implementation. Master plans for the infrastructure sector with significant impact on cities, municipalities, and/or regions, shall be endorsed by the concerned Regional Development Council prior to submission to the INFRACOM.(awÞhi(
The INFRACOM, in coordination with all concerned govenrment agencies, shall evaluate the master plans and ensure that clear funding strategies for the updating, implementation and monitoring of the implementation of said master plans are incorporated therein.
The INFRACOM-approved master plans shall then be endorsed to the NEDA Board for confirmation.
Section 4. Identification of Priority Master Plans. In coordination with all concerned government agencies, the INFRACOM is hereby directed to: (i) conduct an inventory of all exiting master plans due for updating and all proposed master plans for the infrastructure sector; and (ii) identify and approve a list of priority master plans for the infrastructure sector for budget consideration.
Section 5. INFRACOM Secretariat. The INFRACOM Secretariat shall provide necessary technical support to the INFRACOM. To this end, the Secretariat shall: (a) coordinate submissions of agencies of proposed master plans, as well as monitoring of status, implementation and periodic updating of master plans; (b) review draft master plans for presentation to the INFRACOM and NEDA Board; and (c) serve as repository of all master plans for the infrastructure sector.
Section 6. Implementing Guidelines. Within sixty (60) working days from the effectivity of this Order, the INFRACOM shall formulate and issue guidelines for the effective implementation hereof, including the process for review of all existing and proposed infrastructure master plans for the purpose of identifying master plans for prioritization and endorsement for budget consideration.
Section 7. Separability. If any section or part of this Order is declared unconstitutional or invalid, the other sections or provisions not otherwise affected shall remain in full force and effect.
Section 8. Repeal. All issuances, orders, rules and regulations, or parts thereof that are inconsistent with this Order, are hereby repealed or modified accordingly.
Section 9. Effectivity. This Order shall take effect immediately after its publication in the Official Gazette or in a newspaper of general circulation.
